Clint was formerly charged for the assault on July 11, 1853. He was assigned Samuel G. Rice as his counsel. On August 8, 1853, the court found Clint not guilty of "bodily injury by beating with an intent to kill" Forsythe. The court did, though, find Clint guilty of assault and battery. As a result, Clint was subjected to "39 lashes well laid on the bare back, and that the Sheriff execute the sentence and then discharge the prisoner."
